FBIAA Statement on Due Process Protections for FBI Special Agents

The following statement can be attributed to The FBI Agents Association (FBIAA):

“The recent unprecedented and unlawful terminations of FBI Special Agents and the litigation that has followed highlight the urgent need to strengthen due process protections for FBI personnel. Unlike most federal employees, the overwhelming majority of Special Agents do not have the right to appeal personnel actions to the Merit Systems Protection Board (MSPB). The unlawfully fired employees who filed today’s lawsuit are using the limited measures they do have to fight for their Constitutional right to fair treatment and due process.

Extending MSPB rights to all FBI employees is essential to ensuring that active Special Agents can uphold the Constitution, protect the American people, and remain free from the kinds of coercive political demands alleged in the suit.

Congress should act quickly to correct this disparity. Extending full MSPB appeal rights to all Special Agents—rights that most other federal employees already have—will ensure fairness, accountability, and consistency.

FBI Special Agents dedicate their lives to protecting our country, and they deserve the same workplace protections afforded to their federal colleagues.”
